Terms & Conditions
The terms that govern our tree surgery services and your relationship with Hampshire Tree Surgeon.
Last updated: June 2025
1. About us
Hampshire Tree Surgeon provides tree surgery, hedge cutting and related arboricultural services in Winchester and across Hampshire. These terms and conditions apply to all quotations, bookings and services provided by us.
By accepting a quotation or instructing us to carry out work, you agree to these terms.
2. Quotations
All quotations are provided free of charge following a site assessment. Quotations are valid for 30 days from the date of issue, after which they may need to be reviewed if site conditions have changed.
A quotation is based on the information available at the time of assessment. If, when work begins, we discover conditions that differ materially from those assessed (for example, hidden decay, unexpected root spread or additional hazards), we will advise you and, if necessary, revise the price before proceeding.
Quotations include all labour, equipment and waste removal unless stated otherwise in writing.
3. Bookings and confirmation
A booking is confirmed when you accept our quotation verbally or in writing. We will confirm a date for the work and aim to honour that date unless circumstances beyond our control require a change, in which case we will notify you as soon as possible.
4. Access and working conditions
You are responsible for ensuring we have safe, adequate access to the work area on the agreed date. This includes:
- Clearing the area of vehicles, garden furniture or other items that may obstruct access
- Securing pets and ensuring children are kept away from the work area
- Informing us of any underground services (pipes, cables) that may be affected
- Notifying us of any relevant planning restrictions or Tree Preservation Orders (TPOs)
If access is inadequate on the day and work cannot safely proceed, we reserve the right to charge a reasonable call-out fee.
5. Tree Preservation Orders and permissions
Where required, we will check whether a tree is subject to a Tree Preservation Order (TPO) or falls within a Conservation Area before commencing work. If consent is needed, we will advise you and can manage the application on your behalf.
You remain responsible for ensuring that all necessary consents are in place before work begins. We will not carry out work that requires consent without it.
6. Payment
Payment is due on completion of the work unless otherwise agreed in writing. We accept payment by bank transfer or cash. For larger jobs, we may request a deposit of up to 25% of the quoted price prior to work commencing.
If payment is not received within 14 days of the invoice date, we reserve the right to charge interest at 8% above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
7. Cancellation
You may cancel or reschedule a booking with at least 48 hours’ notice and no charge will apply. Cancellations with less than 48 hours’ notice may incur a charge to cover preparation and lost scheduling. We will always try to find an alternative date first.
We reserve the right to cancel or postpone work due to unsafe weather conditions, equipment failure or other circumstances beyond our control. We will rearrange at the earliest opportunity at no additional cost to you.
8. Our work and liability
All work is carried out to British Standard BS 3998 (Recommendations for Tree Work) by NPTC-qualified arborists. We carry £5 million public liability insurance.
We take every reasonable precaution to protect your property and surrounding areas during work. In the unlikely event of damage caused by our negligence, we will address it promptly through our insurance.
We are not liable for:
- Pre-existing damage to trees, structures or underground services not disclosed to us
- Damage caused by a tree falling in a direction that could not reasonably have been anticipated given site conditions
- Any consequential losses arising from the work
- Natural events (wind, storm, disease) affecting trees after our work is completed
9. Waste and timber
Unless otherwise agreed, all arisings (branches, brash and timber) will be removed from site as part of the quoted price. We are a licensed waste carrier.
If you wish to retain any timber or wood chips, please let us know at the time of quotation so this can be accounted for.
10. Complaints
If you are unhappy with any aspect of our work, please contact us as soon as possible. We aim to resolve all complaints promptly and fairly. You can reach us at hello@hampshiretreesurgeon.co.uk or on 01962 000 000.
11. Governing law
These terms and conditions are governed by the law of England and Wales. Any disputes that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to these terms
We may update these terms from time to time. The version in force at the time of your booking will apply to that booking.
